1. Who we are and what these terms cover
This site and its courses are operated by Niche Dental ABN 27 284 318 084 ("we", "us"). These terms apply to every account created on this site and every course, bundle, template and download purchased or accessed through it. By creating an account or making a purchase you agree to these terms.
2. Accounts
Each account is for one named person. Course completions and certificates attach to the account holder by name, so accounts must not be shared; a shared account produces training records that are wrong, which defeats the purpose of the training. You are responsible for keeping your login details secure and for the accuracy of the name and email on your account.
3. What your purchase includes
A course purchase gives the account holder access to that course and its downloads. Templates and other downloads are licensed for use within the purchasing dental practice: you may complete them, adapt them and use them in that practice’s compliance system. You may not resell, republish, or distribute the courses, templates or downloads outside the purchasing practice, including to other practices, whether free or paid. A practice bundle licenses the included staff training for the staff of the purchasing practice.
4. Pricing and payment
Prices are in Australian dollars and include GST unless stated otherwise. Access is provided once payment is processed. Where a coupon or promotional price applies, the terms of that promotion, including any expiry, apply.
5. Refunds
If a course is not what your practice needed, contact us at [email protected] within 14 days of purchase and we will refund it. Nothing in these terms limits your rights under the Australian Consumer Law, including the consumer guarantees that apply to our services.
6. Not legal or professional advice
Our courses and templates are practical guidance and tools, prepared with care against the legislation, codes and standards they reference. They are not legal advice, and completing them does not transfer your practice’s compliance obligations to us. Your practice remains responsible for its own compliance, and the legislation and your licence conditions prevail over anything in our materials. Where your circumstances are unusual, obtain advice specific to them.
7. Keeping content current
Regulation changes. We update course content and templates from time to time, and the date on a document tells you when it was last revised. Materials you have already downloaded do not update themselves; check the course for the current version before relying on a download from an earlier date.
8. Certificates
Completion certificates record that the named account holder completed the named course on the stated date. They are evidence of training completion, not a licence, registration or qualification.
9. Emails
By creating an account you agree that we may email you about your courses, your account, and related compliance updates and offerings from Niche Dental. Every marketing email we send includes an unsubscribe link, and unsubscribing does not affect emails necessary to deliver your course.
10. Intellectual property
The courses, templates and site content are owned by or licensed to us and are protected by copyright. The licence in section 3 is the only right granted; all other rights are reserved. Where our materials adapt government publications, those publications remain subject to their own licences and are attributed within the relevant document.
11. Acceptable use
Do not copy course content for distribution, share your account, circumvent payment, or use the site in a way that interferes with its operation or with other users. We may suspend or close accounts that breach these terms, and where a breach involves redistribution of paid content, we may seek remedies available at law.
12. Liability
To the extent permitted by law, and subject always to the Australian Consumer Law, our liability in connection with the courses and materials is limited, at our election, to resupplying the relevant course or refunding the amount you paid for it, and we are not liable for indirect or consequential loss. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
13. General
These terms are governed by the laws of New South Wales, Australia. If any part of these terms is unenforceable, the rest continue to apply. We may update these terms; the date above shows the current version, and continued use of the site after an update is acceptance of the updated terms.
